What to do before giving an eviction notice&nbsp;<\/h2>\n\n\n\n<p>The Welsh government encourages landlords to make eviction a last resort, exploring other means of solving disputes with their contract holders, such as mediation. This may resolve the issue without the expense involved in going to court.&nbsp;<\/p>\n\n\n\n<p>If negotiation and mediation&nbsp;aren\u2019t&nbsp;working, and you want your tenant to leave, you will need to serve a notice of eviction under the act, specifying the date by which the contract holder should vacate the premises.&nbsp;<\/p>\n\n\n\n<p>Be aware that landlords can only take eviction proceedings if they have followed the correct procedures and fulfilled their obligations to contract holders. These include supplying an up-to-date energy performance certificate (EPC), electrical installation condition report (EICR)&nbsp;and gas safety certificate \u2013 as well as using a tenancy deposit scheme to protect the contract holder\u2019s deposit.&nbsp;&nbsp;<\/p>\n\n\n\n<p>You must also register as a landlord with\u00a0<a href=\"https:\/\/www.rentsmart.gov.wales\/en\/check-register\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Rent Smart Wales<\/a>\u00a0and obtain any necessary licences.\u00a0Another requirement is that you have\u00a0complied with\u00a0the Renting Homes (Fitness for Human Habitation) (Wales) Regulations 2022.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. However, you must provide the tenant six months\u2019 notice to leave.\u00a0<\/li>\n\n\n\n<li><strong>Section 159<\/strong>\u00a0\u2013 This notice is used for a breach of contract \u2013 such as for anti-social behaviour, making a false statement or other conduct prohibited by the contract. In the case of antisocial behaviour, landlords can begin proceedings\u00a0immediately, and there is no notice period. Other cases under section 159 involve a month\u2019s notice.\u00a0<\/li>\n\n\n\n<li><strong>Sections 182 and 188<\/strong>\u00a0are used if your contract holder is in rent arrears. Section 182 is for periodic tenancies, and section 188 is for fixed-term contracts. In both cases, the notice period is 14 days.\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">3. Serve notice to tenants&nbsp;<\/h2>\n\n\n\n<p>To serve notice, you must complete the relevant form and give it to your tenant, ensuring you have done so correctly \u2013 you may need legal advice.&nbsp;You can serve the notice through first class&nbsp;post,&nbsp;but it is advisable to take photographic evidence that you have posted it. Alternatively, you can hand deliver the notice through the property\u2019s letterbox.&nbsp;<\/p>\n\n\n\n<p>The type of form you use will&nbsp;determine&nbsp;whether you will&nbsp;be required&nbsp;to prove the grounds for eviction. For example, for serious rent arrears, you would need to provide a rent statement for the last two years showing the arrears.&nbsp;<\/p>\n\n\n\n<p>The notice will only be valid if you provide the right amount of notice and have&nbsp;complied with&nbsp;your obligations as a landlord, some of which are listed above.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Keep a copy of the&nbsp;notice and sign&nbsp;and date&nbsp;it,&nbsp;because&nbsp;you must supply it to the court.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ensuring the notice is valid&nbsp;<\/h3>\n\n\n\n<p>You must have&nbsp;demonstrated&nbsp;compliance with all the relevant legislation for the notice to be valid. This includes:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Providing the occupation contract holder with a valid gas safety certificate.\u00a0<\/li>\n\n\n\n<li>Providing the occupation contract holder with a valid Electrical Installation Condition Report (EICR).\u00a0<\/li>\n\n\n\n<li>Proof that the tenancy deposit was transferred into a government-approved tenancy deposit scheme and the\u00a0information\u00a0was passed onto the occupation contract holder.\u00a0<\/li>\n\n\n\n<li>Proof of registration and licensing with Rent Smart Wales.\u00a0<\/li>\n\n\n\n<li>Providing the occupation contract holder with a valid EPC (Energy Performance Certificate).\u00a0<\/li>\n\n\n\n<li>Proof that carbon monoxide and smoke alarms have\u00a0been installed where\u00a0required.\u00a0<\/li>\n\n\n\n<li>The contract is a periodic standard\u00a0contract,\u00a0and notice has been served at least six months after the start date of occupation. The contract must also have been provided to the occupation contract holder within 14 days of the occupation date.\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">4. Make a possession claim&nbsp;<\/h2>\n\n\n\n<p>If your contract holder does not leave by the date specified in the notice, you can apply to the court for a possession order.&nbsp;<\/p>\n\n\n\n<p>For standard possession claims, you can apply online, which means you can&nbsp;monitor&nbsp;the progress of your claim. You can also apply on paper using forms N5 and N119. In both cases, it costs&nbsp;\u00a3404 to issue the claim.&nbsp;You should include an&nbsp;additional&nbsp;copy of the forms, which will be&nbsp;forwarded&nbsp;to the contact&nbsp;holder&nbsp;and you should also keep copies for yourself.&nbsp;<\/p>\n\n\n\n<p>The forms should be sent to the county court that handles housing cases for the area that the property is in.&nbsp;<\/p>\n\n\n\n<p>You can apply for an accelerated possession order if your contract holder has not left by the date specified in your Section 173 notice and if you are not claiming rent arrears. It costs \u00a3404. You must complete form N5B Wales and send it to the county court dealing with your area\u2019s housing cases.&nbsp;Cheques should be made payable to \u2018HM Courts and Tribunals Service\u2019.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">5. Attend the court hearing&nbsp;<\/h2>\n\n\n\n<p>You will receive confirmation of the location,&nbsp;date&nbsp;and time of the court hearing. Possession court hearings will&nbsp;generally be&nbsp;held in the county court nearest to the property.&nbsp;<\/p>\n\n\n\n<p>At the court hearing, the judge may:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>adjourn the hearing to a later date\u00a0<\/li>\n\n\n\n<li>dismiss your claim for reasons they will make clear\u00a0<\/li>\n\n\n\n<li>make a possession order.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>The reasons for a claim being dismissed include if you have not followed the correct procedure or if the conditions of the grounds for eviction have not been proved.&nbsp;<\/p>\n\n\n\n<p>If a possession order is made, it will be \u2018outright\u2019 or \u2018suspended\u2019.&nbsp;If outright, your contract holder must vacate the property by a set time \u2013 usually 14 or 28 days but sometimes up to six weeks.&nbsp;<\/p>\n\n\n\n<p>If suspended, your contract holder will be given conditions they must abide by to stay on the property, such as making payments to meet arrears. You may also receive a possession order with a monetary judgment, meaning that the contract holder must vacate the property and pay rent arrears and court costs.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. Apply for a warrant of possession&nbsp;<\/h2>\n\n\n\n<p>Suppose your contract holder does not leave your property by the date given by the county&nbsp;court, or&nbsp;does not meet the conditions in a suspended possession order. In that case, you must get a warrant for possession from the court \u2013 the cost is&nbsp;\u00a3148.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Alternatively, you can apply to the High Court enforcement officer to evict your contract holder. This will cost more but may be quicker. To use this method, you must apply for permission from the county court for&nbsp;\u00a3123 plus a further \u00a380&nbsp;for&nbsp;additional&nbsp;fees.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">7. Evicting the tenant&nbsp;<\/h2>\n\n\n\n<p>Once a warrant for possession has been issued, your contract holder will receive an eviction notice with a date and time the county court bailiff will repossess the property. If the contract holder does not leave, the bailiff will carry out an eviction.&nbsp;<\/p>\n\n\n\n<p>You may attend the eviction but should not enter the property until the bailiff&nbsp;advises&nbsp;that you can do. You should take a spare set of&nbsp;keys,&nbsp;or you may need to call out a locksmith if the occupant has changed the locks, so that the bailiff can enter the property.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Will the Renters\u2019 Rights Act affect landlords in Wales?&nbsp;<\/h2>\n\n\n\n<p>Housing law in Wales is devolved, so&nbsp;the majority of&nbsp;changes in the Renters\u2019 Rights Act (RRA) only apply to the private rented sector in England.
